By accessing or using Engarde's cybersecurity training platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and EnGarde - Little Omega ("Company," "we," "us," or "our").

Engarde provides cybersecurity training services including:

• Interactive security awareness training modules
• Phishing simulation campaigns
• SaaS security monitoring and risk detection
• Compliance reporting and analytics
• Custom training content and tooling

Our Service is designed to help organizations improve their security posture through employee education and awareness.

To use our Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be authorized to accept these Terms on behalf of your organization

You are responsible for all activities that occur under your account.

You agree not to use our Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or conduct actual phishing attacks
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Service
• Use our phishing simulations outside your organization
• Reverse engineer or create derivative works

Violation of this policy may result in immediate termination of your account.

The Service and its original content, features, and functionality are owned by EnGarde - Little Omega and are protected by international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use our Service for your organization's security training purposes only.

You retain ownership of any data you upload to our Service, but grant us a license to process it for service delivery.

Subscription fees are billed in advance on a monthly or annual basis. You agree to:

• Pay all fees when due
• Provide current and accurate billing information
• Notify us of any billing disputes within 30 days
• Accept automatic renewal unless cancelled

Fees are non-refundable except as required by law or as specified in your service agreement.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection and use of information as described in our Privacy Policy.

We strive to maintain high service availability but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with advance notice
• Modify or discontinue features with reasonable notice
• Suspend service for security or compliance reasons
• Update these Terms with 30 days' notice

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our liability is limited to the amount you paid in the 12 months prior to the claim
• We are not liable for indirect, incidental, or consequential damages
• We do not warrant that our Service will prevent all security incidents
• You acknowledge that cybersecurity involves inherent risks

This limitation applies even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless EnGarde - Little Omega from any claims, damages, or expenses arising from:

• Your use of our Service
• Violation of these Terms
• Infringement of third-party rights
• Your organization's security incidents

Either party may terminate this agreement:

• At any time with 30 days' written notice
• Immediately for material breach of these Terms
• Immediately if required by law

Upon termination, your access will cease and we may delete your data after a reasonable retention period.

These Terms are governed by the laws of France. Any disputes will be resolved through:

• Good faith negotiation first
• Mediation if negotiation fails
• Courts of Caen, France for litigation
